Personal data that we process

Three Treasures acupuncture practice processes your personal data because you use our services and / or because you provide them yourself.

Below you will find an overview of the personal data that we process:

Initials, surname and first name.

Sex.

Date of birth.

Special and / or sensitive personal data that we process

Pursuant to the Medical Treatment Agreement Act (WGBO), I as a healthcare provider am obliged to keep a medical file.

The following information is recorded by me in your medical file:

Your healthcare question and main complaint.

Diagnostic data.

Treatment data.


Data from persons under the age of 21

Our website and / or service does not intend to collect data about website visitors under the age of 21. Unless they have permission from their parents or guardian. However, we cannot check whether a visitor is older than 21. We therefore advise parents to be involved in the online activities of their children, in order to prevent data about children from being collected without parental consent. If you are convinced that we have collected personal information about a minor without this permission, please contact us and we will delete this information.


For what purpose and on what basis we process personal data

For a proper treatment it is necessary that your treating therapist keeps a file at the Three Treasures acupuncture practice. This is a legal obligation imposed by the Medical Treatment Agreement Act (WGBO). Your file contains notes about your state of health and information about the examinations and treatments performed. The file also includes information that is necessary for your treatment and that we have requested, if necessary and after your explicit consent, from another care provider, for example from the general practitioner.


The purpose of processing personal data:

Drawing up a medical file on which the treatments are based.

Drawing up the invoice for your health insurance. The invoice you receive contains the information that is requested by the health insurer, so that you can declare this to your health insurer. Your name, address and place of residence, your date of birth, the date of the treatment (s), the performance code and the description "acupuncture treatment".

Maintaining contact with you regarding treatment and / or billing.


The purpose of processing medical data:

• To be able to carry out a suitable treatment for you.


Use of personal and file data

The data from your file can also be used for the following purposes:

Informing other healthcare providers (only with your explicit consent), e.g. when the therapy has been completed or in case of a referral;

For use by a locum in the absence of your therapist;

For anonymous use during peer review;

For the financial administration: the invoice contains your name and address details and date of birth so that you can submit the invoice to the health insurer;

Your e-mail address can be used to send invoices, to make appointments and to ask questions in the context of your treatment.


If we want to use your data for another reason, we will first inform you and explicitly ask for your permission.


Access to your file

Your treating therapist is the only one who has access to the data in your file. Your treating therapist has a legal duty of confidentiality (professional secrecy).

The right of inspection is regulated in Article 35 (paragraph 1, paragraph 2, paragraph 3, paragraph 4) of the Personal Data Protection Act.

You have the right to request correction and deletion of your personal data. The right of correction is regulated in Article 36 (paragraph 1, paragraph 2, paragraph 3, paragraph 4) of the Personal Data Protection Act.


Access to file of a minor

According to the patient rights from the WGBO, the competent minor between 12-16 years old and the parent (s) have custody. Parent (s) of minors up to the age of 16 have co-decision about the treatment. Parents have the right to information and access to the file, when this is linked to the right of codecision for the treatment. There is an exception to this right of access, namely when the professional is of the opinion that the exercise of certain patient rights is contrary to the interests of the patient / client.Competent patients / clients aged 12 and older are themselves authorized to give permission for a breach of confidentiality.


Retention period

The legal retention period for your file is 15 years.


Sharing of personal data with third parties

Three Treasures practice only provides data to third parties if this is necessary for the execution of our agreement with you, or to comply with a legal obligation.


View, modify or delete data

You have the right to view, correct or delete your personal data. You also have the right to withdraw your consent to the data processing or to object to the processing of your personal data by Three Treasures practice and you have the right to data portability. This means that you can submit a request to us to send the personal data we hold about you in a computer file to you or another organization mentioned by you.


You can send a request for access, correction, deletion, data transfer of your personal data or request for cancellation of your consent or objection to the processing of your personal data to Three Treasures practice. To ensure that the request for access has been made by you, we ask you to send a copy of your ID with the request. Black out your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and citizen service number (BSN)  in this copy. This is to protect your privacy. We will respond to your request as soon as possible, but within four weeks.

How we protect personal data

Three Treasures practice takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure and unauthorized changes. The practice  works with a digital client file. If you have the impression that your data is not properly secured or there are indications of abuse, please contact the practice .
